However, it is worth considering again the statute of limitations - either calculate the damage and lost profits for the last three years (if you prove that you have already suffered losses during this time) - or calculate on this moment time.
“The payment for the servitude must be commensurate with the losses caused to the owner of the land plot or other real estate encumbered with the servitude, in connection with the restriction of his rights as a result of the establishment of the servitude. Proportionality of the servitude payment to such losses means that the amount of the servitude payment is equal to the amount of losses caused to the owner of the land plot or other real estate encumbered with the servitude, in connection with the restriction of his rights as a result of the establishment of the servitude.
